Child Porn Lawsuit Against XVideos Dismissed

It’s been about a year now since a lawsuit has been filed against the parent company of xvideos, BangBros, and Penthouse – WebGroup Czech Republic, WGCZ Holding, WGCZ Limited.

The lawsuit in federal court was filed by the National Center of Sexual Exploitation Law Center, which was joined by five other survivor-focused litigation teams.

In short, the argument is that “Jane Doe was trafficked and sold for sex as a child, and many of the acts were recorded and uploaded by XVideos.”

The lawsuit has been making its way through the courts and on January 13th XVideos filed a motion to dismiss the lawsuit due to lack of personal jurisdiction.

Specifically, they stated that they are from the Czech Republic and as such, the US courts have no rights.

A twenty-three-page ruling decided this motion and the court ruled in favor of xvideos,  and that the court grants the motion to dismiss for “lack of personal jurisdiction.”

And while normally that would be that, a new motion was filed and a hearing was held on February 25th in the judge’s chambers and the Court denies the motion as to overturning the order dismissing the plaintiff’s claims against the Foreign Defendants.

The argument is that the court failed to fully address the plaintiff’s arguments. The plaintiffs argued that XVideos does business in the US, targets US consumers, and signs US contracts, so they should be held accountable to the US courts and laws.

In the end, the court did don’t agree however they granted the motion to amend the order to dismiss the claims without prejudice.

A case dismissed without prejudice means it’s not dismissed forever. The person whose case it is can try again.

So for now at least, it looks like the lawsuit against XVideos is over.
