Mercedes Carrera has a new trial date in October

More than a year ago, I wrote this line: “It’s been a long time since her arrest (2019), but it seems Mercedes Carrera is finally going to have her day in court.” That was in May 2023. She still hasn’t had her trial date yet, but she now has one set for October 7, 2024.

Mercedes Carrera and Daemon Cris (also known as Jay Allan or Jason Allan Whitney) were arrested on charges that include eight counts of sexual acts with a child under the age of 10.

  • Jury Trial set for 10/7/2024

Initially, they faced charges for possessing methamphetamine while armed with a handgun. These charges however were later dropped.

The charges emerged after a nine-year-old girl, identified as Carrera’s daughter from a previous marriage, provided detailed descriptions of the alleged abuse during a preliminary hearing.

The child’s testimony played as an audio recording in court, depicted a harrowing four-month period of repeated assaults.

The couple’s apartment, which also served as a site for producing adult content, became a key focus of the investigation. During a police raid, authorities discovered drugs and firearms in the residence. Reports indicate that the child was present during filming sessions, although she was in a different room. These findings have contributed to the disturbing narrative of the living conditions under which the alleged abuses took place.

Mercedes Carrera is Going to Trial - 5 Years Later

Since their arrest, Mercedes Carrera and Daemon Cris have encountered a series of legal hurdles that have delayed their trial. Defense motions and other procedural complexities have extended the pre-trial phase, causing frustration and anticipation among those following the case. Despite these delays, the trial is now slated to begin in October – 5 and a half years later.

Throughout this ordeal, Mercedes Carrera has vehemently denied the allegations, asserting that they were concocted by her ex-husband. Carrera describes her ex-husband as a “fundamentalist Christian” with motives to damage her reputation. Her public statements have emphasized a belief that the accusations are part of a vindictive campaign against her.

Neither the defense nor the prosecution has issued new statements ahead of the trial date. However, the gravity of the charges and the lengthy pre-trial period have kept the case in the public eye. Legal experts suggest that the trial will delve deeply into the evidence presented during the preliminary hearings and the circumstances surrounding the couple’s arrest.

The arrest of Carrera and Cris in 2019 shocked the adult entertainment industry and sparked significant media coverage. Over the years, the case has highlighted issues related to child protection, substance abuse, and the challenges of navigating legal systems when personal and professional lives intersect in controversial ways. As the trial date approaches, it is poised to address these complex issues head-on.

The victim, a child, was said she was sexually assaulted multiple times over a four-month period.

Mercedes Carrera has publicly acknowledged that the child making the allegations is her daughter, with her former husband.

On the 75-minute audio recording of an interview conducted in January of 2019, by San Bernardino Sheriff’s Deputy Steven Theis, the child describes what she called “cuddle sessions” during which Mercedes Carrera and Daemon Cins repeatedly touched her vagina. The girl also alleged to the deputy that on at least one occasion, one of the pair inserted a finger into her vagina.

The case is being heard by the Superior Court of California, County of San Bernardino, with Judge Katrina West. Some of the original charges have changed, so let’s take a closer look at what she is facing when she does finally go to trial.

There are a total of 11 charges pending. They are as follows:

PC288.7(A)-F (1 count) – SDMY: VICTIM UNDER 10YRS

(a) Any person 18 years of age or older who engages in sexual intercourse or sodomy with a child who is 10 years of age or younger.

PC288.7(B)-F (10 counts) – ORAL COP: VICT UNDER 10YRS

(b) Any person 18 years of age or older who engages in oral copulation or sexual penetration, as defined in Section 289, with a child who is 10 years of age or younger.

On February 3, 2022, Jason Whitney aka Daemon Cris was also charged with another Felony – PC4502(A)-F: Prisoner Possess Weapon. This means he was charged with having a weapon while in prison. A “weapon” under this statute includes things such as:

  • blackjack,
  • slungshot,
  • billy,
  • sandclub,
  • sandbag,
  • metal knuckles,
  • any explosive substance,
  • fixed ammunition,
  • dirk or dagger or sharp instrument,
  • pistol,
  • revolver,
  • firearm, or
  • tear gas weapon.

It is unclear what specific weapon he was caught with and how it will affect his sexual assault charges for his case with Mercedes Carrera.

Perhaps we will finally find out on October 7, 2024. I mean, it’s been so long, and they are still in jail. How crazy is that?
