Nevada Introduces Age Verification Bill for Online Adult Content

LEGAL NEWS STRAIGHT

When I think of Nevada, home to Las Vegas (the city of sin) and legalized prostitution, the last thing that comes to mind is the need to censor adult content. But it seems the only place they want you to see someone sucking dick is in one of their hotel rooms.

Nevada lawmakers have introduced Assembly Bill 294 (AB 294), a new age verification measure targeting online platforms that publish content deemed harmful to minors.

Nevada

The bipartisan bill, sponsored by Assembly Members Toby Yurek (R) and Elaine Marzola (D), follows a nationwide trend of state-level regulations requiring age verification for adult websites. However, legal experts warn that the legislation could face significant constitutional challenges similar to those in other states.

Online platforms must implement age verification to restrict minors from accessing content labeled “harmful.”

Acceptable verification methods include:

✔ Government-issued ID upload
✔ Private transactional data (e.g., credit cards)
✔ Third-party verification services

Enforcement:

  • Violators face civil penalties of up to $10,000 per offense.
  • The Nevada Attorney General is authorized to sue non-compliant platforms.

Supporters argue that children are increasingly exposed to explicit content, making age verification essential.

“This bill introduces new regulations to protect minors from accessing harmful online content by requiring platforms to implement robust age verification systems,” said adult industry attorney Corey Silverstein.

“It’s another state jumping on the bandwagon. I doubt Nevada will be the last.”

Critics argue that AB 294 violates constitutional rights and places burdensome restrictions on online platforms.

✔ First Amendment Issues

Opponents claim that requiring age verification for legal content imposes an unconstitutional restriction on speech.

✔ Privacy Risks

Even with non-storage policies, critics warn that requiring ID verification creates security vulnerabilities and discourages legal adult users from accessing content.

✔ Compliance Costs

Small businesses and independent creators could struggle to afford compliance, leading to content suppression.

The Free Speech Coalition (FSC) and digital rights groups are already challenging similar laws in states like Texas, Louisiana, and Utah.

Silverstein believes AB 294 could be overturned if the Supreme Court rules against age verification laws in the upcoming Free Speech Coalition v. Paxton case.

“I consider Nevada’s age verification law just as unconstitutional as similar bills in other states,” Silverstein stated.

“If SCOTUS strikes down Texas’ law, we will see a major shift in these regulations.”

AB 294 has been referred to the Assembly Committee on Commerce and Labor. Its legal implications will be closely watched nationwide as the bill progresses.

With 20 other states already implementing age verification laws, not including international laws, it seems the day of free porn are a thing of the past.
